How to Appeal a Michigan FOIA Denial or Fee
A requester may generally appeal a denial to the head of the public body or proceed to court. The best path depends on the body, issue, timing, and record already developed.
What an appeal should contain
Identify the original request and response, state the word “appeal,” specify the portions challenged, and explain why reversal is warranted. Attach the request, proof of delivery, denial, fee estimate, and relevant correspondence.
Address the actual reason
If the dispute concerns breadth, propose a precise interpretation or staged production. If it concerns an exemption, address the statutory elements and segregability. If it concerns fees, identify the disputed component and calculation.
Administrative appeal versus lawsuit
An administrative appeal can produce a faster correction and sharpen the dispute, but it also consumes time. Michigan law permits judicial review under specified conditions and time limits. A requester considering litigation should obtain advice about the particular facts.
A new request may be different
Changed circumstances, a refined record description, or a different time period may justify a new request. A new request does not necessarily preserve challenges to the earlier denial.
An appeal should make the decision easy to revisit
A useful administrative appeal is short enough to understand and specific enough to act upon. Attach the request and denial, identify the disputed language, explain the error, and state the relief sought. Do not bury the issue beneath every frustrating interaction that occurred along the way.
There are cases in which an appeal is strategically useful and others in which litigation deadlines or the identity of the public body require immediate legal analysis. Preserve the dates and obtain advice promptly when the records are time-sensitive or the dispute is consequential.
