Michigan Police Internal-Affairs and Misconduct Records
Police-accountability records present recurring public-interest and exemption disputes. Separate the complaint, investigative file, final finding, discipline, policy, and aggregate data rather than treating “internal affairs” as one record.
Request distinct categories
Identify citizen complaints, intake records, investigation assignments, interview records, exhibits, findings, final reports, discipline, closing memoranda, and appeal outcomes. Also request the governing complaint and investigation policies.
Personnel-record issues
Michigan FOIA contains a law-enforcement personnel-record exemption subject to a public-interest balance. Internal-investigation records have generated published appellate litigation. The analysis may depend on the particular record and public interest.
Aggregate and policy records
If individual files are contested, request annual complaint counts, allegation categories, disposition data, discipline matrices, retention rules, and anonymized summaries. These can reveal patterns without requiring every personal detail.
Separate the complaint from the investigation
An internal-affairs file may include the original complaint, intake record, notices, interview recordings, exhibits, investigator notes, findings, supervisory review, discipline, and appeal materials. Ask for those components separately so a response does not treat the entire subject as one indivisible file.
Closed and open matters may present different issues. It is often useful to request the governing policy, classification codes, and an investigation log even when the underlying file is disputed. Aggregate complaint and disposition data can also show whether an incident is isolated or recurring.
